I. GENERAL PROVISIONS
- The present Privacy Policy is a document defining the main terms of data processing by Eneris ID Project S.A. (hereinafter: Eneris), in respect to information concerning visitors (users) of this website (hereinafter: the Website).
- Eneris respects the privacy of the individuals who visit the Website and this Privacy Policy aims at presenting the process of visitors’ personal, in order to allow their independent, conscious and free and free assessment and consent as users of this Website.
- Eneris declines any responsibility in respect to sites linked to the Website or referencing or quoting the Website.
- Any eventual change in Privacy Policy would be immediately updated on the Website.
II. DATA PROCESSING ON THE WEBSITE
- Eneris Privacy Policy hereunder is based on EU Regulation 2016/679 dated 27 April 2016 concerning protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), (OJ L No. 119, p. 1).
- Eneris collects no personal data other than IP addresses contained in server logs, which are required for security reasons. User consent is not required before visiting the Website.
- The controller for these processing operations is Eneris officer in charge of this Website.
- Proper display of the Website in visitors browsers is managed by technical devices that verify the update for all content (text, images, video clips, etc.). Website performance, e.g. loading speed is improved with recourse to various technical services such as content delivery networks- CDNsacting on Eneris behalf and upon its instructions. Data collected thereunder is exclusively used for displaying the Website content and is deleted immediately after a temporarily limited storage necessary for this purposes.
- Upon visitor’s browser opening on the Website, Eneris web server (log-log data) collects and store data such as:
- data access hour,
- one hour access URL of the website,
- the URL of the website,
- the version of the HTTP protocol used,
- the files that are opened,
- the amount of data transferred,
- type and version of the web browser,
- type of operating system,
- IP address (in anonymized form).
- Log data (logs) do not contain personal information and do not trace visitor’s identity. Eneris only analyses log data (logs) if and when necessary to proper operation of the Website or to the management of security incidents (notably against intrusions and attacks). Log storageis required for the administration of the Website. In addition, visitor’s IP as well as log data are also needed for troubleshooting purposes or for documenting security breaches. Such data is deleted as soon upon obsolescence, e.g. correction of a connexion/display error, clarification of a security incident. Within the limits set out by the law, in case of security incident, log data – logs are stored and delivered to to the investigating authorities. Log data (logs) are stored separately from other data relevant to the use of the Website.
- Users can file claims relating to the protection of their personal data directly to the controller, i.e. Eneris officer in charge of the Website. Users can also file claims with the Eneris’ data protection officer at the following email address: [email protected]
III. COOKIES POLICY
- Eneris respects the privacy of Website visitors (users) and, subject to Section II above, informs that the Website does not automatically collect any information, except for information contained in cookies.
- Cookies are small text files that are used to analyse users’ browsing patterns and habits, e.g. frequency and duration of their visits, visited pages, language preferences, etc. . Such information is sent by this Website and stored in a special folder on the user’s computer. Cookies generally contain the name of the server, an identifier in the form of a unique number, and an expiry date. The unique identifier allows the website to ‘remember’ the user’s computer whenever they visit the Website.
- Users can decide whether or not to allow the Website to store Cookies on their computers, and in particular adjust their browser settings at any time, including for preventing Cookies acceptance and storage. - Eneris use cookies for web analytics purposes. Eneris’ Cookies are set by Google Analytics. Google Analytics is non-related external service hosted in Europe and operating in compliance with European data-protection regulations. Eneris uses Google Analytics to track the number of visitors and prepare information on their use of the Website, e.g. most viewed pages, duration of the visit, etc.. This information allows Eneris to improve the Website and manage the best possible access to Eneris information. Eneris does not use advertising cookies.
Website Terms & Conditions
I. GENERAL PROVISIONS
- The present terms and conditions (hereinafter: Terms & Conditions) define the scope and conditions the services rendered by Eneris ID Project S.A. (hereinafter: Eneris) to the visitors (users) of the website: https://www.eneris.com (hereunder: the Website).
- Each user shall read the Terms & Conditions and abide by their provisions, or decline to use the Website and exit.
- Any user may store these Terms & Conditions by printing, saving on a storage medium or downloading at any time from the place where it was made available.
- These Terms & Conditions and users’ use of the services provided through the Website are governed by the Laws of the Grand Duchy of Luxembourg.
- Eneris reserves the right to make changes to the Terms & Conditions at any time, wihtout however infringing specific rights previously acquired by the users hereunder nor the provisions of the Amendments will be published on an ongoing basis in the form of a consolidated text of the Terms & Conditions on the Website and will be effective 14 days after such publication. The user’s use of the Website after such amendments to the Terms & Conditions enter into effect constitutes acceptance of such amendments and novate any prior understanding.

- Unless otherwise stipulated, the Website, all the elements contained therein (text, photos, graphics, sound, animation and videos including layout), and the information are proprietary to Eneris and protected by the relevant intellectual propertylaws, including on trademark or copyright.

Furthermore, the Website may not be reproduced in full or in part, in any form whatsoever, and using any means whatsoever, without first obtaining prior written authorisation from Eneris.
- Unless otherwise stated in the Terms and Conditions, all trademarks, brand names, logos and other indications appearing on the Website (hereinafter: Trademarks) are protected and proprietary. Permission to use this Website by the user does not constitute permission to use the marks appearing on the Website. Any use of the trademarks, or similar marks or names, is prohibited unless Eneris consents in advance and in writing or a provision of law provides otherwise.
III. APPLICABLE LAW AND COMPETENT COURTS
- Any dispute concerning this Website and its use (notably under both the Terms and Conditions which regulate any use of the Website)shall be subject to the laws o the Grand Duchy of Luxembourg law and any claims shall be raised under exclusive jurisdiction of the courts of Luxembourg.
IV. TYPES AND SCOPE OF SERVICES PROVIDED COVERED BY THE TERMS AND CONDITIONS
- Through the Website, Eneris provides the following services (hereinafter: Services) free of charge electronically to the extent and under the conditions specified in the Terms and Conditions:
- information service, which consists in providing visitors (users) with access to text, graphic and multimedia materials on a variety of topics, which are made available through the Website at the individual request of the user in such a way that the user can access them at a time of his/her choosing, whether directly to the general part of the Website or, for certain elements of information in restricted areas of the Website;
- search service, which consists of allowing the user to remotely search and display data stored on the Website;
- download service, which consists in enabling the user to download fragments of content or entire files made available on the Website
- none of the above elements include any offering, any representation or warranty nor induce or confer any right to users against Eneris or other persons referred to in the Website, which would only apply upon express written agreements between the relevant parties.
